Thomas Grossmann, a sole proprietorship, doing business as European Motorhome Tours is a tour operator specializing in guided RV Tours. By booking your tour with us, you agree to the terms of this agreement. Completion of registration and payment of deposits shall constitute understanding and agreement with company policies and these Terms & Conditions.
If you do not agree with our Terms & Conditions you should not proceed with making a tour registration. It is your responsibility to be familiar with these Terms & Conditions and to check our website at rvtoureurope.com from time to time for any changes. The Terms & Conditions at the time of your booking supersede any Terms & Conditions in any printed materials, for example in our catalog. These Terms & Conditions together with any other documents we provide you describe what you are legally entitled to expect from us when you book your tour through us, in addition to important obligations you make as a customer that affect your legal rights.
The terms “we”, “us” and “our”, and “European Motorhome Tours” and “EMT” refer to Thomas Grossmann, a sole proprietorship, dba European Motorhome Tours. The terms “you”, “participant”, “customer”, “tour member”, “driver”, and “guest” refer to the customer booking a tour with us.
You represent and warrant that (a) you are of sufficient age to use our services and website and can create legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these Terms & Conditions on their behalf, and (c) the information supplied by you is true and correct. You understand that you are financially responsible for our services and those for whom you make a registration for.
Payment Terms
The organization and operation of RV Touring requires extensive long-term planning and costs are incurred long before the actual departure date. In consideration for this planning the following deposit & final payment terms apply:
All prices and fees are quoted and invoiced in US Dollar ($). Payments must be made in US funds.
A deposit of $600 per person is required to confirm your registration. The final balance is due 120 days prior to departure.
We reserve the right to cancel your reservation that will be subject to the below cancellation policy should we not receive any payment due in full and on time.
Payments can be made by bank transfer (international wire transfer to our USD account in Germany) or by major credit cards, including Visa, MasterCard, and Discover, through our secure website. Your authorization is a binding agreement for us to charge your card and as such you waive any right to chargeback without prior written consent from European Motorhome Tours in the case of cancellation for any cause (except fraud), including a Force Majeure event, as defined herein, and agree to refund policies and procedures as outlined in these Terms & Conditions.
Cancellation Policy
A written notice by e-mail to info@rvtoureurope.com is required to cancel your reservation.
Tours begin at 12:01am on day of rendezvous in Germany. No refunds will be given once the tour has begun.
Refunds are subject to the following:
- 150 days or more prior to departure: 100% of monies paid will be refunded less a standard cancellation fee of $100 per person.
- 149 to 120 days prior to departure: The amount of the deposit ($600 per person) will be retained.
- 119 to 60 days prior to departure: 15% of the tour price will be retained from monies paid.
- 59 to 45 days prior to departure: 35% of the tour price will be retained from monies paid.
- 44 to 30 days prior to departure: 50% of the tour price will be retained from monies paid.
- 29 days or less prior to departure: 75% of the tour price will be retained from monies paid.
The tour price is defined by the price quoted in your registration confirmation and/or invoice. All remaining monies paid will be refunded. Refunds as applicable by this cancellation policy are paid within 30 days upon receipt of your written notice of cancellation.
Monies are refunded to the original payer and are not transferable. Refunds are made in US funds by either a credit to your original payment card, an international bank/wire transfer or by check.
Cancellations by European Motorhome Tours
European Motorhome Tours reserves the right to cancel any tour at its sole discretion. In the unlikely event a tour is cancelled by European Motorhome Tours and we are unable to reschedule, all funds collected from any participant will be refunded in full except in the case of Force Majeure. European Motorhome Tours is not responsible for any additional arrangements guests have made, such as air travel or other travel arrangements preceding or following the tour.
Force Majeure
European Motorhome Tours shall not be responsible for, and shall make no refund for, events beyond its control, such as, without limitation, acts of God, or of government, strikes or other labor activities, acts of war, whether declared or not, civil disturbance, riot, theft, pilferage, fire, cancellations, changes of schedules or operational decisions of transportation operators, terrorist activity or the threat thereof, industrial action, natural or nuclear activity, insurrection or revolt, epidemic, pandemic, accidents, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation, forces of nature, adverse weather conditions, adverse road conditions, criminal activity, or for acts or omission of third parties or other parties not under the control of European Motorhome Tours and all similar events outside our control.
Medical Emergency
We cannot be responsible for medical emergencies. Should you need to leave the tour early for any reason, no refund will be provided.
Medical Disclaimer
You must notify us, at or prior to booking, of any medical, physical, or other condition, which may require professional attention during a tour or may require the use of special equipment. No refunds are provided if you are not able to participate in any parts of the tour due to any such conditions.
Participants with disabilities are welcome and must always be accompanied by a travel companion who will be a fully paying registered guest and must be capable of providing all required and needed assistance. It is the responsibility of the guest, not European Motorhome Tours, to see to any and all of your special needs required during the duration of the tour. Please note that facilities outside of the USA may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility. In addition, many historic sites and old towns may not be suitable for walker/scooter/wheelchairs due to steep slopes, steps, cobblestone and other features, and extended walking may be required for access to many pedestrian only zones and sites.
European Motorhome Tours will make any reasonable effort to accommodate guest with limited mobility. Any additional costs incurred due to such accommodation are the sole responsibility of the guest.
European Motorhome Tours reserves the right to decline any tour participant who, in our opinion, is unfit for travel and/or may affect the health, safety or enjoyment of other participants.
It is also necessary to advise European Motorhome Tours of your special dietary needs. While most vendors used on our tours will be able to accommodate your dietary needs, please be prepared to provide for your own special dietary needs. European Motorhome Tours is not responsible for food prepared by Third Parties.
Rental Motorhomes
Your tour package includes the cost of a rental motorhome with motor insurance from our rental agency suppliers ("Rental Agency"). European Motorhome Tours acts solely as an intermediary between you and the Rental Agency. The Terms & Conditions ("Rental Agreement") of the Rental Agency apply to your motorhome rental and can be found here:
International Driving Permit
To rent and operate the rental RV each guest expected to drive is required to present to the Rental Agency and to carry during the tour a valid domestic US/Canadian/Australian driver license and an International Driving Permit (IDP) which is a translation of your domestic driver license into multiple languages. European Motorhome Tours bears no responsibility related to improper documentation to operate a vehicle in any given country or government decisions related thereto. We recommend that you keep copies and/or scans of your driving license and International Driving Permit while traveling.
Mechanical Breakdown
In the unlikely event of a mechanical breakdown of the rental RV, European Motorhome Tours will provide any reasonable assistance in order to obtain repairs or a replacement RV from the Rental Agency in accordance with the Rental Agreement. No refunds will be provided should you miss any parts of the tour due to such breakdown and subsequent delay.
Non-Responsibility
European Motorhome Tours, our employees, proprietor/owner, agents, independent contractors, and representatives, acts only as an agent for the transportation companies, sightseeing contractors and other principals included in the itinerary and is not a principal or operator for the subject services. European Motorhome Tours is an independent contractor and is not an employee, agent, or representative of any of these suppliers. European Motorhome Tours does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel, RV park or restaurant, or any other entity that supplies services related to your tour (suppliers). European Motorhome Tours is not affiliated with any other tour operator. All suppliers are independent contractors and are not agents or employees or representatives of European Motorhome Tours. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all customers agree that neither European Motorhome Tours, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour participant or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of European Motorhome Tours including financial default of a supplier.
European Motorhome Tours assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any participant that may result from any act or omission on the part of others including but not limited to the failure of any transportation mechanism to arrive or depart timely or safely, whether by plane, train, auto, taxi, bus, boat, by foot, or by any other conveyance.
European Motorhome Tours shall be relieved of any obligations under these Terms & Conditions in the event of a Force Majeure.
You assume all risks associated with physical exertion for which you are not prepared; negligence or recklessness by you or others; consumption of alcoholic beverages; risks associated with food or impure water; high altitude sickness; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided.
Navigational assistance provided by European Motorhome Tours, such as GPS routes, GPS co-ordinates, trip logs, maps, traffic rule information, and verbal directions, are to be regarded as supplemental travel aids. European Motorhome Tours provides no warranty as to the completeness or accuracy of the travel aids provided. You remain solely and fully responsible to abide by all traffic rules and regulations and also for any damage to your rental RV that occurs if we are assisting you during driving or parking.
European Motorhome Tours accepts no responsibility for stolen, lost, or misplaced property; and theft or break-ins into RVs, automobiles, lodging rooms or elsewhere.
Additional Risks
Additional risks and dangers may arise including, but not limited to, hazards of travel by RV, train, automobile, motor coach, boat, aircraft and other means of conveyance, animal interactions, swimming, forces of nature, political unrest, other unrest, risks associated with water, food, plants, insects and differing animal regulation, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. Therefore, the only function of European Motorhome Tours is to organize and facilitate the tour. Anyone going on said tour agrees to fully assume all risks of accident, illness, injury, infection, death or damages to themselves or their property. Further, they hereby release, hold harmless and agree to indemnify European Motorhome Tours and its affiliates, agents, contractors and employees from all liability, damage claims, demands, inconveniences, distress, frustration or cause of action – whether physical or mental. Neither European Motorhome Tours or third-party providers of outside services shall be held liable for any act, error, or omission.
Liability Waiver
The participant acknowledges that they will be required to sign a Liability Release & Assumption of All Risk Agreement (Liability Waiver) provided by European Motorhome Tours prior to participating in any tour. Failure to sign the Liability Waiver will cancel participant’s tour and will not be eligible for a refund.
The Liability waiver is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assignees.
Travel Protection Coverage
European Motorhome Tours strongly encourages you purchase travel/medical/baggage protection for the trip. You should ensure that any plan you choose covers the risks you are concerned about, such as trip cancellation or interruption for medical issues due to injury or illness, cancellation for any reason, medical expenses, emergency evacuation/repatriation, and baggage loss.
European Motorhomes Tours cannot provide advice regarding the adequacy of your selected insurance coverage nor do we sell travel insurance or endorse specific insurers. Please refer to a qualified insurance agent for any questions regarding travel protection.
Some countries may require you to carry valid medical insurance on entry and you should carry written proof of coverage with you. European Motorhome Tours is not responsible if a guest is unable to provide details to authorities of insurance and is denied entry for this or any other reason.
Changes to Price, Itinerary, Tour Activities & Overbooking
European Motorhome Tours prices tours well in advance of travel. Our dedication is to provide the best quality and pricing on any guided RV tour. Itineraries and prices are subject to change only due to improvements and/or number of days and/or activities.
While no changes are anticipated, there may be occasions when certain alterations become necessary. These can be due to religious holidays, national celebrations, or unforeseen events including weather, governmental closures, acts of God, or any other reason. European Motorhome Tours reserves the right to change the itinerary, activities, travel route, and/or meals due to such unforeseen circumstances, emergencies, or as we deem necessary. Such alterations shall be made without penalty to European Motorhome Tours, its employees, agents or contractors.
Additionally, historic sites undergo renovations from time to time which can obscure viewing or otherwise change the nature of visiting these sites. No tours will be cancelled due to renovations if such sites remain open, although European Motorhome Tours may choose to amend itineraries for such sites. These changes will not be considered a material change and will not be considered cause for cancellation by the guest. If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement. In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage will be against the supplier of the alternate activity.
The regular maximum number of participating guest rigs is 10. Due to last minute cancellations, European Motorhome Tours reserves the right to overbook any tour by two (2) rigs. Should any moving tour have less than five (5) rigs, the Wagonmaster/Tourleader may also perform the duties of the Tailgunner.
International Travel
By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk. It is the responsibility of the participant to become informed about the most current travel information, advisories and warnings by referring both to the U. S. State Department’s travel website at www.travel.state.gov and by accessing the Centers for Disease Control (CDC) website at https://wwwnc.cdc.gov/travel/ or the equivalent resources of your resident country. Should you choose to travel to a country that has been issued a travel warning or advisory, European Motorhome Tours will not be liable for damages or losses that result from travel to such destinations.
Trips outside the USA/Canada/Australia require a valid US/Canadian or Australian passport or other acceptable forms of citizenship proof. Passports must be up to date with an expiry at least 6 months after the trip return date. It is your sole responsibility to secure and/or pay for all visas, reciprocity fees, affidavits, immunizations, etc. that are required to be permitted entry into each destination. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/exit fees which will be collected at the airports upon entry/departure by local government authorities. Please note that entry to any country may be refused even if the required information and travel documents are complete. European Motorhome Tours bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.
It is the participant’s responsibility to ensure that all the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. We recommend that you keep a copy and/or scan of your passport (photograph page) while traveling.
Guest Responsibility
Participants are responsible for their personal health, behavior, actions, driving infractions, insurance, rental RV and group co-operation.
European Motorhome Tours reserves the right to remove from a trip, without refund, any person deemed in violation of respecting the laws and customs of states and or countries visited; refusal to follow environmental guidelines and regulations while on a trip in accordance with Wagonmaster/Tourleader direction; incapable of meeting the rigors and requirements of participation, or who is abusive to other trip participants, tour staff or third parties. An individual may be asked to leave a trip if the Wagonmaster/Tourleader feels that the person’s continued participation and conduct may prove detrimental to the individual or to the well-being and enjoyment of other guests.
Children under 18 must be accompanied on all tour activities.
Tour participants are responsible to arrive on time in Germany at the starting point of the tour. Any guest who does not show up for the tour or any parts of the tour, deviates from, or leaves the group early for any reason whatsoever, forfeits his/her fees paid.
It is understood and accepted that the function of European Motorhome Tours is to organize and facilitate the tour. It is agreed that whoever is going on said tour is doing so entirely upon their own initiative, risk and responsibility (not acting under anyone else’s direction and/or control during said tour or rally), and will have complete and unrestricted control over their vehicles in accordance with the Rental Agreement. The driver of the RV or other vehicle is ultimately responsible for any damages to their property or the property of others and solely responsible for avoiding obstacles and/or dangerous situations, adhering to local traffic rules, directions and actual road and weather conditions.
It is the guest’s responsibility to possess all required travel documents, to follow all local laws, regulations and ordinances, to comply with customs and currency regulations, and to adhere to the rules & regulations of all sightseeing sites, tour operators and RV parks.
When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation, RV rental company or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us.
Guests agree not to hold European Motorhome Tours liable for any actions taken under these Terms & Conditions.
Baggage and personal effects are always the sole responsibility of the participant.
Model and Statement Release
The tour participant grants full permission to copyright and/or publish pictures or videos of his/her likeness taken during the tour. You give permission to reprint, copyright, or publish written statements given by you on the questionnaire. Said picture(s) and/or written statements may be used for future publicity and advertising or any other lawful purpose without compensation. You waive any right to inspect or approve final copies of finished product(s) or advertising material that may be developed.
The participant acknowledges that they will be asked to sign a Model and Statement Release Agreement provided by European Motorhome Tours prior to participating in any tour.
Jurisdiction and Applicable Law
The laws of the Federal Republic of Germany at the principal place of business of European Motorhome Tours shall govern the jurisdiction, venue, interpretation and construction of the Terms & Conditions and the Liability Release, without regard to conflict of law. All guest claims must be submitted in writing and received by European Motorhome Tours no later than thirty (30) days after the completion of the tour. Guest claims not submitted and received within this time shall be deemed waived and barred.
Severability
If any provision of these Terms & Conditions shall be held unenforceable, such provision shall be struck and the remainder shall remain enforceable.
